• You agree to notify JOTIQ immediately of any unauthorized use of your account.
• You may not share login credentials with others.

4. User Responsibilities and Legal Compliance

4.1 Local Law Compliance

You are solely responsible for ensuring that your use of JOTIQ complies with all applicable local, regional, national, and international laws, including but not limited to:

• Telemarketing, robocall, and cold-calling regulations
• Privacy and data protection laws (e.g., GDPR, CCPA, PDPA, TCPA)
• Consent requirements for sending commercial communications

JOTIQ does not provide legal advice and does not monitor your compliance. You must seek your own legal counsel if necessary.

4.2 Geographical Restrictions

Certain features (e.g., AI-powered voice outreach) may be restricted or prohibited in certain jurisdictions. You are responsible for confirming the legality of using these features where you operate.

4.3 Consent Obligations

You must obtain and maintain all necessary consents and permissions before using JOTIQ to contact any individual. JOTIQ does not verify or store proof of such consents.

4.4 U.S. TCPA Compliance

AI voice calling to U.S. mobile numbers is strictly prohibited without prior express written consent. Violations of the TCPA may result in substantial legal penalties, which you agree to bear exclusively.

5. Prohibited Uses

You may not use JOTIQ to:

• Violate any applicable law or regulation.
• Send spam or unsolicited messages in violation of anti-spam laws.
• Harass, threaten, or abuse any person or organization.
• Interfere with the platform's security or functionality.
• Remove or obscure JOTIQ branding without permission.
• Upload or distribute viruses or malicious code.

JOTIQ reserves the right to suspend or terminate accounts engaged in prohibited activities.

6. AI-Generated Content

You acknowledge that emails, messages, and call scripts generated by JOTIQ's AI are suggestions only. You are solely responsible for reviewing, editing, and ensuring that all outbound communications are legally compliant and appropriate for your recipients.

7. Marketing and Publicity Rights

By using JOTIQ, you grant us the right to display your company name and logo in marketing materials, case studies, social media, and sales presentations, unless you opt out by contacting privacy@jotiq.ai.

This right applies only while you have an active account, unless otherwise agreed in writing.

8. Limitation of Liability

JOTIQ provides its services "as is" and "as available" without warranties of any kind.

JOTIQ is not liable for:

• Any legal consequences resulting from your outreach activities.
• Any violations of laws (e.g., GDPR, TCPA) by users.
• Indirect, incidental, special, or consequential damages.

JOTIQ's total cumulative liability shall not exceed the amount you paid to JOTIQ in the three (3) months preceding the event giving rise to the claim.

9. Service Modifications

We may modify, suspend, or discontinue any part of the platform at any time, with or without notice.

10. Termination

We may suspend or terminate your account if you violate these Terms or engage in unlawful use of the platform.

You may terminate your account at any time by contacting support@jotiq.ai.

11. Governing Law

These Terms are governed by the laws of the State of Delaware, USA, and any disputes shall be resolved in the courts of Delaware.

12. Changes to the Terms

We may update these Terms periodically. Material changes will be communicated via the platform or by direct notice. Continued use constitutes acceptance of the updated Terms.

13. Acceptance

By using JOTIQ, you confirm that you:

• Accept full responsibility for complying with all laws applicable to your use of JOTIQ.
• Acknowledge that JOTIQ is not responsible for your outreach compliance.
